These Terms of Use are the rules for using jorgeviteri.com and for the texts, calls and emails you receive from Jorge Viteri. The site offers general real estate information and an easy way to reach Jorge, but using it does not make him your agent, and nothing on it is legal, tax or lending advice. The text-messaging terms below explain what texts we send and how to stop them at any time.

Who We Are

In these Terms, “Jorge,” “we,” “us” and “our” mean Jorge Viteri, REALTOR®, a real estate salesperson licensed in California (DRE #01739762). Jorge works under the supervision of his responsible broker, California Home Service (broker of record Vicente Saucedo, DRE #01031184).

Accepting These Terms

By using this website, or by submitting a form on it, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, please do not use the site. You can still call Jorge at (909) 268-6440.

Agreeing to these Terms does not, by itself, mean you agree to receive text messages. See Text Messaging (SMS) Terms.

Who Can Use This Site

You must be at least 18 years old to submit a form or sign up for texts. The site is not directed to children under 13. Please use it only for lawful, personal purposes related to buying, selling, investing in or learning about real estate.

No Agency Relationship Until We Sign an Agreement

Browsing the site, submitting a form, getting a home valuation, or calling, texting or emailing Jorge does not create an agency, fiduciary or client relationship.
Jorge represents you only after you sign a written agreement with California Home Service, through Jorge as its salesperson: a listing agreement if you are selling, or a written buyer representation agreement if you are buying.
Before you sign, Jorge will give you the California “Disclosure Regarding Real Estate Agency Relationship” required by Civil Code § 2079.14.
Under California law, a buyer representation agreement must be in writing and signed no later than when you make an offer, and for individual buyers it cannot last more than 3 months at a time.
As a member of the National Association of REALTORS®, Jorge will ask you to sign a written buyer agreement before he tours a home with you.
Until you sign an agreement, please do not share confidential information you would not want passed on, such as the highest price you would pay or the lowest price you would accept.
Jorge will act for both the buyer and the seller in the same transaction only with everyone’s written consent.
At new-home communities, the builder’s on-site sales staff represent the builder, not you. Many builders require your agent to register you at or before your first visit, so talk to Jorge before you visit a community if you want him to represent you.

General Information Only

The guides, city pages, program descriptions and other content on this site are general information. They may be incomplete or out of date. Programs such as CalHFA loans, down payment assistance, first-time buyer programs and ITIN loans, and limits such as loan limits, are set by lenders and government agencies and change often.

Jorge is a licensed real estate salesperson. He is not an attorney, accountant, tax advisor, lender, mortgage loan originator or investment adviser. Nothing on this site is legal, tax, lending, accounting or investment advice. Before you make a decision, talk to the right professional, such as an attorney, a CPA or a licensed lender. Investment content does not promise any return.

Home Valuations

A free home valuation from Jorge is an opinion of value, also called a comparative market analysis, prepared by a licensed real estate agent. It is not an appraisal.
Do not use it for lending, tax, legal or court purposes. If you need an appraisal, hire a licensed appraiser.
It is not a guarantee of the price your home will sell for. It depends on the sales data and the information about your home’s condition available when it is prepared, and markets change.

New-Construction Homes and Builder Promotions

Builder promotions and incentives, such as rate buydowns, closing-cost credits, upgrades and prices, are offered by the builder, not by Jorge.
They change often and can sell out or end without notice. Many require the builder’s preferred lender, credit and loan approval, and other eligibility rules, and all are subject to the builder’s own terms.
Confirm every term in writing with the builder and your lender before you rely on it. Our summaries do not replace the builder’s purchase contract, the California Department of Real Estate Subdivision Public Report, or your lender’s Loan Estimate.
If a promotion mentions an interest rate or payment, your actual rate, APR and payment come from your lender and depend on your loan approval.
If a builder may pay Jorge for representing you, he will tell you in writing before you sign anything.
Our new-homes questionnaire is in Spanish, but the same information and help are available in English. Call or email Jorge.

Financing Information and Referrals

Jorge is not a lender or mortgage loan originator. He does not make loans, quote loan rates or decide whether a loan is approved. Choosing a financing option on our forms, such as “Need help with financing” or “ITIN loan,” simply tells Jorge what kind of help you want.
Whether you qualify for a loan, and at what rate and terms, is decided only by the lender.
If you ask, Jorge can suggest lenders, escrow and title companies, inspectors and other professionals. These referrals are a courtesy, and you are free to choose any provider you want. We do not accept compensation for referrals where the law prohibits it, and we will tell you in writing about any business relationship we have with a provider we recommend.

Property, Market and Sold Information

Property details, market statistics, and information from the MLS, public records and builders are believed to be reliable but are not guaranteed. Check anything important yourself, such as square footage, schools, HOA dues, property taxes, Mello-Roos assessments and permits.
The sold examples on this site are homes in which Jorge took part in the sale as an agent, representing the buyer or the seller.
Past results do not guarantee future results.

Reviews and Testimonials

Testimonials on this site come from real clients and describe their own experiences. They are not a guarantee or prediction of your results, and results vary. English versions of reviews written in Spanish are translations.
We do not pay for reviews or offer anything in exchange for positive ones. If a reviewer received anything of value from us, we say so next to the review.
We use a client’s name or photo only with their permission.
Nothing in these Terms limits your right to post an honest review of Jorge anywhere.

Commissions and Free Services

Real estate commissions are not set by law and are fully negotiable between you and the broker. Any compensation is stated in a written agreement.
Home valuations and consultations are free and come with no obligation. Jorge does not charge any upfront fees for them.

Program description

Program name: Texts from Jorge Viteri, REALTOR®
Sender: Jorge Viteri, REALTOR®, DRE #01739762, California Home Service (DRE #01031184)
What we send: text messages about your real estate inquiry, home valuation, appointments and transaction and, only if you check a box that includes promotional texts, promotional messages about new-construction homes, builder incentives and listings. Messages may be sent using automated technology.

How you join

We text you only if you check a text-message consent box on one of our forms, or if you text Jorge first. The boxes are optional and are not checked in advance, and you can submit any form without checking them. On most forms there is one box for texts about your inquiry and a separate box for promotional texts. On our new-homes questionnaire, a single box covers both texts about your request and promotional texts. We send promotional texts only if you check a box that includes them.
You do not have to agree to texts to buy or sell with Jorge or to get a home valuation. You can always reach him by phone or email instead. Consent is not a condition of purchase.
By agreeing, you confirm that you are at least 18 and that you are the account holder or an authorized user of the mobile number you gave us. If you change or give up that number, please tell us.
Only Jorge texts you under this program. Builders, lenders and other companies cannot use your consent to text you; they need your own separate permission. Your consent cannot be transferred to anyone else.

How often and how much

Message frequency varies. Message and data rates may apply. Contact your wireless provider for details about your plan.

How to opt out

Reply STOP to opt out. You will receive one text confirming your opt-out, and then no further texts from us. Replying STOP stops all texts from Jorge, both informational and promotional. Replying STOP also stops any automated or prerecorded calls from us.

You can also opt out by any other reasonable means, including replying QUIT, END, REVOKE, OPT OUT, CANCEL or UNSUBSCRIBE, telling us in your own words in English or Spanish (for example, “ALTO,” “BAJA” or “ya no me manden mensajes”), calling (909) 268-6440, or emailing jorgeviteri61@gmail.com. We honor opt-out requests promptly, and no later than 10 business days.

To start receiving texts again, reply START or UNSTOP, or check a text-message consent box again on one of our forms.

Carriers are not liable for delayed or undelivered messages.

Privacy

We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes. Phone Calls and Email

Jorge may call and email you about your inquiry, using the contact details you give us and as described in the consent on our forms.
We make promotional calls only with your consent, and use automated technology or prerecorded messages only as your consent allows. If we ever record or transcribe a call, we will tell you at the start of the call. If an automated assistant ever contacts you for us, we will tell you that it is automated.
Every promotional email includes an unsubscribe link and our postal address, 12592 Central Ave, Chino, CA 91710. We honor unsubscribe requests within 10 business days. Emails about an active transaction continue until it is complete.
You can ask to be put on our internal do-not-call list, or tell us “stop all contact,” by phone, email or text, at any time.

Intellectual Property

The text, guides, photos, graphics and design of this site belong to Jorge or to the people who license them to him, such as photographers and builders. You may view and print pages for your own personal, non-commercial real estate use. You may not copy, republish, sell, frame or scrape the site’s content without written permission.

REALTOR® is a collective membership mark that identifies members of the National Association of REALTORS®. The Equal Housing Opportunity logo, builder names, and WhatsApp, Facebook, Instagram and Google belong to their owners. Their appearance on this site does not mean they endorse us. If you believe something on this site infringes your copyright, contact us and we will review it and remove it if appropriate.

Third-Party Websites and Services

This site links to websites and services we do not control, such as WhatsApp, builders, lenders, government housing programs, maps and the California Department of Real Estate. Their own terms and privacy policies apply when you use them, and a link is not an endorsement. If you tap a WhatsApp link, WhatsApp, which is owned by Meta, handles your conversation under its own terms.

Privacy

Our Privacy Policy explains how we collect, use and share personal information, including through cookies, analytics and advertising tools, and how to use your privacy choices.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THIS WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT PROPERTY, MARKET, SCHOOL, TAX, FINANCING OR PROGRAM INFORMATION ON THE SITE IS ACCURATE, COMPLETE OR CURRENT, OR THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.

Limitation of Liability

This limit applies only to the website and its general content. It does not apply to fraud, willful injury or misconduct, gross negligence, violations of law, or any duty under a written brokerage agreement or California real estate law. Indemnity

If you submit false information or another person’s contact details, or break the law or these Terms when using the site, you agree to cover the reasonable costs we incur from third-party claims caused by that conduct. This does not apply to claims caused by our own negligence or misconduct.

Resolving Disputes

Talk to us first. If you have a concern about this site or our communications, contact Jorge and describe the problem. We will try in good faith to resolve it within 30 days. This step does not apply to small claims cases, to urgent requests for a court order, or where waiting would make you miss a legal deadline.
Mediation. If we cannot resolve it, either of us may suggest mediation. Mediation is voluntary.
Small claims. You can always bring a claim in small claims court if it qualifies.
No required arbitration. These Terms do not require arbitration.
Governing law. California law governs these Terms, without regard to conflict-of-law rules.
Where to file. To the extent permitted by law, cases about these Terms will be heard in the Superior Court of California, County of San Bernardino. This does not take away your right as a consumer to bring or defend a case in the county where you live or where you signed a contract, or to use small claims court.

Your Written Agreements Come First

If you sign a listing agreement, buyer representation agreement, purchase agreement or other transaction documents, those documents control over these Terms for your relationship with Jorge and California Home Service and for your transaction, including their terms for resolving disputes.

Changes to These Terms

We may update these Terms. The effective date at the top tells you when they last changed. For material changes, we will post a notice on this site and, where practical, email active clients. Changes apply only going forward. They do not apply to a dispute that arose, or that we knew about, before the change. If you keep using the site after we post a change, the updated Terms apply to your future use. Previous versions are available on request.

General Terms

If any part of these Terms is found unenforceable, the rest stays in effect.
If we do not enforce a part of these Terms right away, we can still enforce it later.
These Terms are the full agreement about your use of this website, subject to any written agreement described above. Our Privacy Policy explains how we handle personal information.
We may assign these Terms only as the law allows. Your consent to receive texts from Jorge cannot be transferred to anyone else.
Headings are for convenience only.
The sections on intellectual property, disclaimers, limitation of liability, indemnity and resolving disputes continue to apply after you stop using the site.
